Terms and Conditions for Arista Hair Co.

Welcome to the Arista Hair Co. mobile application (the “App”), provided by Arista Hair Co. (“Arista,” “we,” “us,” or “our”), located at 6925 West 151st Street, Overland Park, KS 66223. These Terms and Conditions (“Terms”) govern your access to and use of the App and any related services, including booking appointments, managing your client profile, viewing services and products, processing payments, and receiving communications (collectively, the “Services”).

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Eligibility and User Accounts

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the App. You agree to provide accurate, current, and complete information when creating an account and to update it as needed. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized access.

2. Services Offered

The App allows you to:

  • Browse and book hair salon services (including hair replacement/integration systems, extensions, color services, balayage, highlights, keratin smoothing treatments such as Keratherapy Brazilian Renewal, Extreme Renewal, Express Renewal+, Color Lock & Smooth, bridal updos, and other offerings).

  • Purchase retail products and supplements (e.g., Nutrafol).

  • Manage appointments, view your history, and receive reminders.

  • Access client resources, consent forms, and policies.

  • Receive promotional communications, loyalty rewards, and personalized recommendations.

All services are subject to availability and our professional discretion. We reserve the right to refuse or cancel any booking for any reason.

3. Appointments, Cancellations, and No-Shows

  • Bookings are confirmed only upon payment of any required deposit or full prepayment.

  • Cancellation Policy: You must cancel at least 24 hours (for standard services) or 48 hours (for premium/bridal services) before your appointment. Cancellations within this window may result in a fee up to 50% of the service cost or forfeiture of any deposit.

  • No-Shows: Failure to appear without notice will result in a no-show fee (typically 100% of the service cost) and may restrict future booking privileges.

  • We may cancel or reschedule appointments due to unforeseen circumstances (e.g., staff illness, weather, or salon closure). You will be notified promptly, and we will work to reschedule at no extra charge where possible.

4. Payments and Refunds

All payments are processed securely through the App. You authorize us (or our third-party payment processors) to charge your selected payment method for services, products, deposits, and any applicable taxes or surcharges (including credit card surcharges where permitted).

  • Refunds: Refunds are issued at our discretion and in accordance with service-specific policies. Generally, no refunds are provided for completed services, opened retail products, or custom hair systems. Deposits may be non-refundable.

  • Pricing is subject to change. Promotional offers have specific terms and may not be combined.

5. Health, Safety, and Consent

By booking services, you represent that you are in good health and have disclosed all relevant medical conditions, allergies, or sensitivities. Certain services (e.g., keratin treatments, extensions, color) require signed consent forms, which may be provided digitally via the App. We are not liable for adverse reactions resulting from undisclosed conditions or failure to follow aftercare instructions.

6. Intellectual Property

The App and all content (text, images, logos, service descriptions, and software) are owned by Arista Hair Co. or our licensors and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent. Photos or media you upload may be used by us for marketing purposes unless you opt out in writing.

7. User Conduct

You agree not to:

  • Use the App for any unlawful purpose or to transmit harmful content.

  • Harass staff, post false reviews, or interfere with salon operations.

  • Attempt to gain unauthorized access to the App or related systems.

We may suspend or terminate your account for violations.

8. Privacy and Data

Your privacy is important to us. Our Privacy Policy (available in the App and on our website) explains how we collect, use, and protect your information, including appointment details, payment data, and health-related information shared for service safety. By using the App, you consent to the practices described in the Privacy Policy.

9. Disclaimers

The App and Services are provided “as is” and “as available.” We do not warrant that the App will be error-free, uninterrupted, or compatible with all devices. Salon services are performed by licensed professionals, but results vary by individual. We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose, to the maximum extent permitted by law.

10. Limitation of Liability

To the fullest extent permitted by law, Arista Hair Co., its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App or Services, even if advised of the possibility. Our total liability shall not exceed the amount you paid to us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Arista Hair Co. from any claims, losses, or damages arising from your violation of these Terms, your use of the App, or your interactions at the salon.

12. Governing Law

These Terms are governed by the laws of the State of Kansas, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the state or federal courts located in Johnson County, Kansas.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via the App or email. Your continued use after the effective date constitutes acceptance of the revised Terms.
